Your use of the BookingBuddy.com Blog (“Blog”) is subject to the terms of use at http://www.bookingbuddy.com/terms.php (“Terms of Use”), the privacy policy at http://www.bookingbuddy.com/privacy.php (“Privacy Policy”) and these Supplemental Terms (collectively, the “Blog Terms”). Your use of this Blog constitutes your agreement to the Blog Terms.  Smarter Travel Media LLC ("Smarter Travel") may, in its sole discretion, modify or revise these Blog Terms at any time by updating its Terms of Use policy or these Supplemental Terms. You are bound by any such modification or revision and should therefore visit our Terms of Use policy and Supplemental Terms frequently to review the terms. If you do not accept and abide by these Blog Terms, you may not use this Blog. In the event of an inconsistency between the Terms of Use, Privacy Policy and these Supplemental Terms, these Supplemental Terms control.

1. Description of the Blog. This Blog is considered a “Forum,” as that term is defined and used in Section 7 of the Terms of Use, and you should review that Section prior to using this Blog. This Blog allows users to post information, news and content (collectively, “Entry”) related to travel and destinations in the comments to the Blog. Smarter Travel does not review, edit or moderate any Entry before it appears on the Blog. You acknowledge and understand that this Blog and each Entry is provided on an AS-IS and AS-AVAILABLE basis without warranty of any kind, and from time to time an Entry might be inaccurate or misleading. Smarter Travel disclaims all responsibility and liability for the availability, timeliness, security or reliability of the Blog, and you hereby acknowledge that Smarter Travel has no obligation or liability associated with such Entry, even if Smarter Travel has been advised that the Entry is inaccurate or misleading. Smarter Travel also reserves the right to modify, suspend or discontinue the Blog with or without notice at any time and without any liability to you. Smarter Travel reserves the right to terminate the Blog.

2. Acceptable Use. You agree that you are responsible for your own use of the Blog, for any Entry you make, and for any consequences associated with your Entries or your use of this Blog.  

Without limiting your other obligations, you specifically agree to abide by the posting policies and restrictions described in Section 7 of the Terms of Use. You also agree that you will use the Blog in compliance with all applicable local, state, national, and international laws, rules and regulations, including any laws regarding the transmission of technical data exported from your country of residence and all United States export control laws. Violation of any of the foregoing, including Section 7 of the Terms of Use, may result in immediate termination of these Blog Terms, termination of your Blog and/or account, and may subject you to state and federal penalties and other legal consequences.

You acknowledge and understand that this Blog may contain Entries with offensive, harmful, inaccurate or otherwise inappropriate material, or in some cases, Entries that have been mislabeled or are otherwise deceptive. We expect that you will use common sense and exercise caution and proper judgment when using this Blog. Smarter Travel reserves the right, but does not have any obligation, to investigate Entries (whether yours or others) in order to (a) determine whether a violation of the Blog Terms has occurred or (b) comply with any applicable law, regulation, legal process or governmental request. Smarter Travel does not support, endorse, agree with, warrant, represent or guarantee the accuracy, reliability, truthfulness or viability of every Entry or piece of content on the Blog. You acknowledge that any reliance on material posted on the Blog will be at your own risk, and you hereby release Smarter Travel from any liability associated therewith. Smarter Travel reserves the right to terminate your access to the Blog.

3. Content. Without limiting your other obligations, you specifically agree that the licenses and related terms in Sections 7 and 8 of the Terms of Use govern the content and materials contained in the Entries and comments. 

4. Removal Guidelines. Without limitation, if your conduct fails to meet any of the following guidelines, Smarter Travel may remove any Entries, comments or other postings which:

a.  defames abuses, harasses, stalks, threatens or otherwise violates the legal rights (such as rights of privacy and publicity) of others; 

b.  contain any profanity, threats, prejudiced, hate speech, defamatory, infringing, harmful, threatening, racially/ethnically objectionable, abusive, vulgar, obscene, indecent or unlawful material or information, graphic reports of criminal activity, reports of death, or otherwise objectionable or non-family-friendly content;

c.  contain any material that infringes any patent, trademark, copyright, trade secret or other proprietary right of any party (the "Rights"), unless you are the owner of the Rights or have the permission of the owner to post or transmit such material; 

d. contains any material that is off-topic, unlawful, is harmful to minors in any way, contains nudity or pornographic material, promotes or provides instructional information about illegal activities, or promotes physical harm or injury against any group or individual;

e.  is written by anyone under the age of 13;

f. links to any websites or files; 

g.  advertises or offers to discount, offer, or sell any goods or services for any commercial purpose or any promotional material;

h.  conduct or forward surveys, raffles, contests, pyramid schemes, chain letters, or any other similar solicitations or calls to action; 

i.  uploading, downloading, posting, emailing, messaging, transmitting, or otherwise making available files, code, software, junk mail, commercial advertisements, or any other form of commercial solicitation;

j.  misrepresent your identity or impersonate another person or entity, or falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is posted; 

k. without Smarter Travel’s express written consent, you  hold yourself out as sponsored by, endorsed by, or affiliated with Smarter Travel;

l. attempts to gain unauthorized access to Smarter Travel's database(s) or other computer systems or attempts to modify, translate, adapt, edit, decompile, disassemble, or reverse engineer any software programs used by Smarter Travel; and/or

m. interferes, restrict, disrupts, diminishes, or inhibit the quality of, interferes with the performance of, the functionality or the enjoyment of the Blog, ;

All judgments concerning the applicability of these guidelines shall be at the sole and exclusive discretion of Smarter Travel.

5. Privacy. As a condition of using this Blog, you agree to the terms of the Privacy Policy at http://www.bookingbuddy.com/privacy.php, as updated from time to time.
